§ 1 Scope of Application and Provider
These General Terms and Conditions apply to all orders placed by natural or legal persons via the online store at www.homerugs.ch . The operator of the online store is Negra AG, Uraniastrasse 33, 8001 Zurich, Switzerland, hereinafter referred to as “Negra”.

§ 2 Conclusion of the Contract
§ 2.1 The presentation of products in the online store does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
§ 2.2 By clicking the “Place Order” button, you are submitting a binding offer to purchase the products contained in the shopping cart.
§ 2.3 Upon receipt of your order, you will receive an automatic confirmation via email. This confirmation of receipt does not yet constitute acceptance of your purchase offer. The purchase contract is only concluded when we accept your order by sending an order confirmation via email or by shipping the goods.
§ 2.4 Please note that standard dimensional variations of up to 3% may occur with carpets. Therefore, please measure the intended area carefully and allow for some extra space.
§ 3 Prices
The prices displayed in the online shop at the time of ordering apply. All prices are in Swiss francs (CHF) and include Swiss statutory value-added tax and other price components. Shipping costs, if applicable, are shown separately during the ordering process. We reserve the right to correct any obvious input, display, or pricing errors.
§ 4 Shipping Costs
Standard shipping within Switzerland and to Liechtenstein is free of charge. Any additional costs for special delivery methods or additional services will be listed separately during the ordering process.
§ 5 Delivery Terms and Availability
§ 5.1 Unless otherwise agreed or specified in the offer, delivery will be made at our discretion via DHL, Planzer Transport AG, DPD, Swiss Post, or another suitable shipping or transport company.
§ 5.2 Unless otherwise specified for the respective product, the delivery time is approximately 10 to 21 business days. We will adhere to delivery times whenever possible. Should delivery be delayed or a product be unavailable in exceptional cases, we will inform you immediately.
§ 5.3 If not all ordered products are available at the same time, we are entitled to make partial deliveries at our expense, provided this is reasonable for you.
§ 5.4 If delivery fails for reasons for which you are responsible, despite reasonable attempts at delivery, we may withdraw from the contract. In this case, payments already made will be refunded, less the verifiable shipping, return, and processing costs incurred.
§ 5.5 If, in exceptional cases, an ordered product is unavailable, we will inform you immediately. In this case, we may suggest a comparable product or withdraw from the contract. In this case, any payments already made will be refunded in full.
§ 6 Terms of Payment
§ 6.1 Payment may be made by prepayment, credit card, PostFinance, TWINT, or PayPal, provided that the respective payment method is offered during the ordering process.
§ 6.2 If you select prepayment as your payment method, we will provide you with our bank details in the order confirmation. The invoice amount must be transferred to our account within 5 business days. If payment is not received by the due date, we may cancel the order.
§ 6.3 You are only entitled to set off claims if your counterclaims have been legally established, are undisputed, or have been acknowledged by us in writing.
§ 6.4 You may only exercise a right of retention to the extent that the claims arise from the same contractual relationship.
§ 7 Retention of Title
To the extent permitted by law, the goods remain our property until full payment has been made. This is subject to the mandatory legal requirements for the validity of a retention of title.
§ 8 Voluntary Right of Return
§ 8.1 We voluntarily grant private customers a 30-day right of return for goods purchased in our online store, effective from the date of receipt of the goods.
§ 8.2 To exercise the right of return, simply send a clear notification via email to kontakt@homerugs.ch or by phone at +41 (0)44 210 12 01. Please include your order number if possible so that we can quickly process the return.
§ 8.3 The goods must be returned to us within 30 days of receipt. The customer is responsible for the return shipping costs, provided that the delivered goods match the ordered goods.
§ 8.4 Upon receipt and inspection of the returned goods, we will refund the purchase price via the same payment method used for the order. A refund will only be issued for goods that are returned complete, clean, undamaged, and without signs of use.
§ 8.5 Please return the goods in the original packaging, if possible, and with all packaging components. If the original packaging is no longer available, please use suitable protective packaging to prevent damage during transport.
§ 8.6 The voluntary right of return does not apply to goods that have been manufactured, cut to size, customized, or clearly adapted to personal needs according to customer specifications. This applies in particular to custom-made items, special orders, individually configured rugs, and rugs from the Limited Edition brand, as these are manufactured exclusively to individual order. Products excluded from the right of return are marked accordingly in the online shop.
§ 8.7 Statutory warranty rights remain unaffected by this voluntary right of return.
§ 8A Return Shipping Costs When Exercising the Right of Return
If you exercise your voluntary right of return, you are responsible for the return shipping costs, provided that the delivered goods match the goods ordered.

If goods are delivered with obvious damage caused during shipping, we ask that you, if possible, file a complaint with the delivery company immediately and contact us as soon as possible. Your statutory warranty rights remain unaffected by this.
§ 10 Transfer of Risk
The risk of accidental loss or accidental deterioration of the goods passes to the customer upon delivery of the goods. If the customer is in default of acceptance, this shall be deemed equivalent to delivery.
§ 11 Warranty
Statutory warranty rights apply. In the event of defects in the delivered goods, the customer is entitled to the statutory claims under Swiss law.
Damage resulting from improper use, improper cleaning, lack of or incorrect care, normal wear and tear, or unauthorized modifications to the goods is excluded from the warranty.
§ 12 Liability
We assume unlimited liability for damages resulting from willful misconduct and gross negligence, as well as for personal injury and in accordance with mandatory statutory provisions, in particular the Product Liability Act.
Otherwise, our liability is excluded to the extent permitted by law. Liability for indirect damages, consequential damages, and lost profits is excluded to the extent permitted by law.
We assume no liability for damages resulting from improper use, improper cleaning, lack of or incorrect care, failure to follow care instructions, normal wear and tear, or misuse of the goods.
§ 13 Data Protection
Negra AG processes personal data in accordance with the Swiss Data Protection Act (DSG). Where the General Data Protection Regulation (GDPR) applies, its requirements are also observed.
The processing of personal data is carried out on the basis of the purposes and legal grounds described in the Privacy Policy, in particular for the performance of a contract, to safeguard legitimate interests, or on the basis of explicit consent.

§ 14 Final Provisions
§ 14.1 Should any provision of these General Terms and Conditions be invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The relevant statutory provisions shall apply in place of the invalid provision.
§ 14.2 Swiss substantive law applies to all legal relationships between you and Negra AG, excluding conflict-of-laws provisions. Mandatory statutory provisions, in particular mandatory jurisdictions for consumers, remain reserved.
§ 14.3 For customers residing in Switzerland, the statutory places of jurisdiction apply. To the extent permitted by law, Zurich is the exclusive place of jurisdiction.
§ 14.4 The version of these General Terms and Conditions valid at the time of the order shall apply. We reserve the right to amend these General Terms and Conditions with effect for future orders.
